Today the Municipal Digger removed the "tower"
obstruction on the road to the muellecito.
Victor Gonzalez sued ACDEC, after they told
him he had to remove his obstruction. He lost that

Today at 4:00PM I am told the city attorney Geigel
filed criminal charges against Señor Gonzalez.
There is an old saying amongst us older ones,
"Don't mess with the Culebrense". It's something
we say to newcomers. It actually has two meanings.
One, live and let live. Two, the good nature and
relaxed nature of the locals should not be confused
with "their easy" The Island is very tolerant and
accomodating, but when they have had enough,
look out, it's over.
Look at this Gonzalez mess, warnings from Noramid
Peña, Calendar editorials, "WE hope this was an
oversight", the Mayor reluctant to intervene with a
guy who presented himself as an environmentalist
and who had a major land transaction with his father.
But as the Island fretted over the Mayor's reticence,
a lot of us knew there would come the day when
enough is enough. Congratulations to the Mayor
and the Island patriots who stood up for our rights!

For those of you who missed the struggle with Gonzalez, here is a reprint
of my May 2005 editorial,
The island is revving up. The passionate appeal by Nora Peña
(Denying access to Paradise - July Calendar) has really focused our
Island on what may happen to us if we don’t take action now.
I visited the Resaca helipad after recently hearing it had been bulldozed.
The helipad is intact, but the perimeter has been cleared for about
10-15 feet, rocks, cactus, and all, pushed over the edge. Some of it is quite
precarious to the old hiking trail. The two-lane old military road
is being patched here and there. The rumor is the new owner wants
to put in a Windmill Farm. The new owner, Victor Gonzalez, is a board
member of the National Fish and Wildlife Foundation. For all the good work
the NFW does, we hope Mr. Gonzalez will take time to explain his intentions.
There are neighboring properties to consider, the old historical
access road, the wonderful hiking trails. Mr. Gonzalez, if your ideas
are good for the Island, we will understand, we like good ideas. Is
your policy bulldoze first, answer questions later? .
Most of us are hoping that you will be a good neighbor. But your f
irst step was to bulldoze one of most beautiful lookouts in the
Caribbean. Do you have any idea of how many couples have
photographed each other on those rocks.You have destroyed
one of our treasures, we only have so many.
Maybe you ought to visit with our City Council and Mayor and
find out
what our treasures are, before you destroy something else. Even if
our City Council and Mayor like your windmills, you should be able to
install them without destroying our treasures. If your guys can’t figure it
out, we have talent on this island that can. It would be a feather in
your cap to hire local men. Considering your NFW background, we
are hoping this was an unfortunate misstep. Give us something we
can
support and be proud of,
If you decide to do nothing, you are really going to be a popular guy.
How about a big house for you and Mrs. Gonzalez, and dedicate the
rest to nature trails and wildlife....Now that’s something that
is good for you, good for us, good for our tourists, and good for
our wildlife.mCulebra brings out the best in us.....We hope it brings out
the best in you!

Arrogance combined with willful ignorance is an always volatile combination. What a waste of time, resources and energy for so many; had he but taken the Culebrense road with those who love this island passionately yet share it willingly, instead of thinking he could steal what can't be bought anyway...

MUELLECITO ACCESS OPEN...
CRIMINAL CHARGES AND FINE LAUNCHED AGAINST BEACH BLOCKER
The municipality of Culebra scores a huge (and we hope final) victory in the struggle to free the access road to Flamenco beach area known as the muellecito! Most of you will be familiar with multiple charges filed by the industrialists Victor Gonzalez on members of the community for tresspassing, when he first bought the option to buy areas of Mt. Resaca and immediately blocked the traditional access road. This victory represents the possibility of success when a community unites in defense of their rights. The victory would not be possible if not for the hundreds of folks who turned out to these court cases to express their outrage to the press. What follows is a summary of how the access was restored through technical channels.
When the concrete "bird watching towers" were constructed on the access road, Maricarmen filed querella with ARPE (ADMINISTRATION OF REGLAMENTS AND PERMITS)and notified ACDEC (AUTHORITY OF CONSERVATION AND DEVELOPMENT OF CULEBRA). ARPE wrote back immediately confirming the illegality of the structure. At a public hearing the people filled the room in support of free access to beaches. The municipal government of Culebra crafted a beach access ordinance that was well focussed and strong. A regulation was created to implement the ordinance. ACDEC wrote Gonzalez stating the illegal structures must be removed, and letting him know that he does not have the right to block access. He had 30 days to appeal to ACDEC, but instead chose to file a mandamus against the agency in court. The judge ruled last week that the court did not have jurisdiction since Gonzalez did not abide by the munipality's policy.
Unbelieveably, just a day or two after this ruling, the road is blocked again, this time with a huge boulder placed dead center the concrete "bird watching tower." This block did not last long, as anonymous heroes from town apparently removed it. Yesterday, the 18th of October, 2007, municipal government tore down the illegal towers, and, at 4:00pm in the afternoon, Lic. Geigel filed criminal charges referencing the penal code for sabotaging a public access road which can result in fines of $5,000.00 for the block, or between three and eight years in prison.
Any future blocks could serve as a continued source of sorely needed revenue for the Municipal Government of Culebra!
